§2 Definitions

  1. Seller – Two of Art, conducting business activity in accordance with the information provided above.

  2. Buyer / Client – a natural person, legal entity, or organizational unit making a purchase in the online store.

  3. Goods / Works of Art – items offered by the Seller, including new, contemporary, or old and used works of art (antiques, paintings, sculptures, prints, etc.).

  4. Online Store – the website available at www.twoofart.com, enabling the conclusion of distance sales agreements.

  5. “Collectible Item” – means an artwork, book, print, graphic, photograph, or other object of artistic, historical, or collectible value, whose worth derives from its unique characteristics, age, condition, provenance, or cultural significance.
    Each collectible item is offered as an individual piece and may show signs of wear consistent with its age.
    An old collectible book is one that:
    • is no longer in commercial circulation as a regular usable copy,
    • holds value due to rarity, condition, first edition status, autograph, or provenance,
    • is not purchased for everyday use, but as part of a collection or investment.

§3 Scope of Activity

  1. The Two of Art online store sells artworks within the Netherlands and other European Union countries.
  2. All prices are listed in euros (EUR) and include VAT, where applicable.
  3. Used artworks may be subject to the VAT margin scheme, in accordance with EU and Dutch regulations.

§4 Nature of the Offered Works

  1. The items offered may be new, used, or collectible — this is always specified in the product description.
  2. Old, used, or collectible works may bear traces of use and the passage of time, which do not constitute a defect.
  3. Product descriptions and photos are for reference purposes, but the Seller makes every effort to accurately represent the actual condition.
    In case of doubt, please request additional photographs.

§5 Ordering Procedure

  1. Orders can be placed through the store’s website.
  2. The sales contract is concluded at the moment the Seller confirms the order and the Buyer makes the advance payment.
  3. The Seller reserves the right to refuse an order if the artwork is unavailable or if there are justified doubts regarding the authenticity of the Buyer’s details.

§6 Payments

  1. Payment for the ordered artwork is made in advance via bank transfer or through the available online payment systems.
  2. If payment is not received within 7 days of placing the order, the order will be canceled.

§7 Delivery

  1. Deliveries are made within the Netherlands and to other EU countries.
  2. The cost and method of delivery depend on the nature of the artwork (e.g., dimensions, weight, value).
  3. The Seller uses professional packaging and may insure the shipment during transport.
  4. Personal collection is possible by prior arrangement.

§8 Right of Withdrawal

  1. Consumers have the right to withdraw from the contract within 14 days of receiving the artwork, without stating a reason.
  2. To exercise the right of withdrawal, the Buyer must inform the Seller via email (info@twoofart.com) and use the withdrawal form provided.
  3. The returned item must be sent back in its original condition, properly secured, to the Seller’s registered address.
  4. The Buyer bears the cost of returning the item.
  5. The right of withdrawal does not apply to:
    • artworks made to order,
    • items that have been permanently altered or customized at the Buyer’s request.
  6. Return of a collectible item:
    In the event of withdrawal, the Consumer must return the item in the same condition in which it was received, together with all accompanying documents (e.g., certificate, condition report).
    The Seller reserves the right to deduct from the refund an amount corresponding to the reduction in the item’s value resulting from its use or damage.

§9 Complaints and Liability

  1. The Seller is responsible for the conformity of the goods with the contract in accordance with EU and Dutch law.
  2. Complaints may be submitted electronically to: info@twoofart.com.
  3. For used artworks, a certain degree of wear or age-related change is considered acceptable.
  4. The Seller is not liable for minor color variations resulting from monitor settings.

§10 Personal Data and Privacy

  1. Personal data is processed in accordance with the General Data Protection Regulation (GDPR, EU 2016/679).
  2. The data controller is Two of Art.
  3. Data is used solely for order fulfillment and communication with the Buyer.

§11 Governing Law and Dispute Resolution

  1. Contracts concluded with the Seller are governed by Dutch law, taking into account EU consumer protection regulations.
  2. Any disputes will be resolved amicably in the first instance, and if no agreement is reached – by the competent court in Amsterdam.
